Guidelines for Determining the Amount of Compensation for Non-Pecuniary Damage in Cases of Discrimination
The three OSCE field operations: OSCE Mission to Bosnia and Herzegovina, OSCE Mission to Serbia and OSCE Mission to Skopje supported the development of Guidelines for Determining Non-pecuniary Damage in Cases of Discrimination (Guidelines).
These Guidelines are the result of an extensive and inclusive consultation process involving members of the judiciary, academia, civil society, and independent institutions. They rely on both international standards and the national legislation adopted in the field of non-discrimination, and more than fifteen years of the case law of international and domestic courts.
The Guidelines are structured and broadly divided into the following four groups: general principles, circumstances relating to the act of discrimination, circumstances relating to the victim of discrimination and finally, circumstances relating to the perpetrator of discrimination.
